These Terms & Conditions ("Terms") govern your use of services provided by Create A Vision LLC ("Create A Vision," "we," "us," or "our"), including design, marketing, IT services, cloud infrastructure, and AI services. By engaging Create A Vision for any service, you agree to these Terms. Please read them carefully.
1 Services Covered
These Terms apply to all services offered by Create A Vision, including but not limited to: branding, web design, web development (WordPress, Shopify, WooCommerce, custom builds), mobile app development, digital marketing (SEO, SEM, social, email, and other advertising services), managed networking, access control and security camera installation, cybersecurity, business email setup, AV and conference room installation, computer repair, POS system setup, managed hosting, cloud infrastructure, and AI services. Where a specific service has terms unique to it, those are addressed in the relevant section below, in addition to the general terms that apply across all services.
2 Acceptable Use Policy
Create A Vision reserves the right to intervene with any site, application, or system hosted or managed on its infrastructure in the interest of protecting our clients and the integrity of our services. This includes suspending or removing: material supplied by a client that infringes or allegedly infringes on the intellectual property rights of a third party; content violating applicable law; or activity that threatens the security or performance of our infrastructure or other clients. Create A Vision shall be the reasonable judge of what constitutes a violation of this policy, and will make reasonable efforts to notify the client before taking action except where immediate action is necessary to prevent harm.
3 Payment Terms
Payment terms, including pricing, billing frequency, and accepted payment methods, are specified in your service agreement or invoice. Recurring services (hosting, managed IT, marketing retainers) are billed on the agreed schedule; late or failed payments may result in suspension of service after reasonable notice. One-time project work (design, development, installations) follows the payment schedule outlined in the applicable proposal or contract. Refunds, where applicable, are governed by the specific terms of your service agreement.
4 Design & Development Services
Design and development projects include an agreed scope of work and number of revision rounds, specified in your proposal. Work beyond the agreed scope may be billed separately. Upon full payment, ownership of final deliverables (designs, code, and content created specifically for you) transfers to the client, excluding any third-party assets, licensed stock content, or pre-existing tools, frameworks, and code libraries used in the build, which remain subject to their original licenses.
5 Hosting & Cloud Services
We aim to provide reliable hosting and cloud infrastructure but do not guarantee uninterrupted, error-free service. Scheduled maintenance will be communicated in advance where practical. Clients are responsible for the legality of content hosted on their accounts. Backup services, where included, do not eliminate the client's own responsibility to maintain independent copies of critical data.
6 On-Site IT & Physical Installations
For networking, access control, security camera, and AV installation services performed on your premises, you are responsible for providing safe and reasonable access to the work site. Create A Vision is not responsible for pre-existing conditions of the property or building infrastructure not directly related to the installed systems. Hardware is covered by its manufacturer's warranty; installation labor warranty terms are specified in your service agreement.
Access control and security camera systems are configured according to specifications you approve before installation. You are responsible for ensuring your use of these systems complies with applicable surveillance, privacy, and employment laws in your jurisdiction.
7 POS System Setup
Create A Vision provides setup, configuration, and network integration for point-of-sale systems. We do not process, store, or have access to payment card data — all card transactions are handled directly by the payment processor you select, under that processor's own compliance obligations (including PCI-DSS). Create A Vision is not responsible for the payment processor's fees, terms, uptime, or compliance status.
8 AI Services
AI-powered tools we build or configure (chatbots, voice agents, automation) rely on third-party AI models and may occasionally produce inaccurate, incomplete, or unexpected output. We do not guarantee specific business outcomes (e.g. sales, lead volume, or cost savings) from AI services, and recommend human review of AI-generated content and decisions before they are relied upon for consequential business purposes.
9 Computer Repair Services
While we take reasonable care during diagnostics and repair, data loss can occur during hardware or software service, particularly on already-failing devices. You are responsible for maintaining backups of important data before service, and Create A Vision is not liable for data loss except where caused by our gross negligence. Devices left unclaimed after a reasonable period following notice of completion may be subject to storage fees or disposal, as specified at time of service.
10 Intellectual Property
Create A Vision retains ownership of its own pre-existing tools, code frameworks, and methodologies used to deliver services. Client-specific deliverables are owned by the client upon full payment as described in Section 4. Create A Vision may display completed work in its portfolio and marketing materials unless otherwise agreed in writing.
11 Warranty Disclaimer
Except as expressly stated in a specific service agreement, services are provided "as is" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
12 Limitation of Liability
To the fullest extent permitted by law, Create A Vision's total liability for any claim arising from our services is limited to the amount paid by you for the specific service giving rise to the claim. Create A Vision is not liable for indirect, incidental, or consequential damages, including lost profits or lost data, except where such limitation is not permitted by applicable law.
13 Termination
Either party may terminate ongoing services according to the notice period specified in your service agreement. Create A Vision reserves the right to suspend or terminate service immediately for non-payment or violation of the Acceptable Use Policy described in Section 2.
14 Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions.
15 Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
